Free Trade History

Indiana Wineries enjoyed Free Trade for over 30 years: 1971 to May 2005

  • Direct Shipments to Indiana Customers were allowed
  • Direct Sales to Indiana Retailers were allowed
  • Direct Sales to Consumers in Tasting Rooms were allowed

As a result of a 2005 US Supreme Court Case and subsequent changes to Indiana’s statute, Indiana Wineries lost most of their Free Trade Status

    • May 2005 - Direct Shipments to Indiana Customers Disallowed – ATC Bulletin
    • May 2006 – HEA 1016
    • Direct Sales to Indiana Retailers Repealed
    • Shipments Limited to 3,000 Cases to ALL Indiana Customers per Winery
    • Requires the Customer to First Visit the Winery before shipment
